These Terms and Conditions ("Terms") govern your use of the services provided by Premium Home & Office Services LLC ("Company," "we," "us," or "our"), operating as PHO Services, located at 2450 Greenbrier Ln, La Habra, CA 90631. By scheduling, requesting, or receiving any cleaning or janitorial services from us, you agree to be bound by these Terms.
1. Services
PHO Services provides residential and commercial cleaning and janitorial services as described on our website and in service agreements. The specific scope, frequency, and pricing of services will be outlined in a written or verbal service agreement between the Company and the client.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We are not liable for any modification, suspension, or discontinuation of services.
2. Scheduling and Appointments
All appointments must be scheduled in advance by contacting us via phone, email, or through our website contact form. Appointments are subject to availability and are confirmed upon our written or verbal confirmation.
Clients must provide accurate and complete information regarding the property to be cleaned, including size, number of rooms, and any special requirements. Failure to do so may result in additional charges or rescheduling.
3. Access to Property
The client is responsible for ensuring that PHO Services personnel have safe and unobstructed access to the property at the scheduled time. If access is denied or the property is not accessible, the client may be charged a lockout fee as outlined in the service agreement.
The client warrants that they have the legal authority to grant access to the property for cleaning services. PHO Services is not responsible for any disputes arising from unauthorized access permissions.
4. Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, check, and electronic payment methods as specified at the time of service. All prices are subject to change with prior notice.
Invoices not paid within 30 days of the service date may incur a late fee of 1.5% per month on the outstanding balance. The client is responsible for all costs of collection, including reasonable attorney's fees.
5. Cancellation Policy
Clients may cancel or reschedule appointments with at least 24 hours' notice without penalty. Cancellations made less than 24 hours before the scheduled appointment may be subject to a cancellation fee equal to 50% of the scheduled service cost.
PHO Services reserves the right to cancel appointments due to unforeseen circumstances, including but not limited to severe weather, equipment failure, or personnel illness. We will make every effort to reschedule at the earliest available time.
6. Satisfaction Guarantee
We stand behind the quality of our work. If you are not satisfied with any aspect of our service, please notify us within 24 hours of service completion. We will return to re-clean the unsatisfactory area at no additional charge.
This guarantee does not apply to damage caused by pre-existing conditions, client-provided cleaning products, or areas not included in the original service scope.
7. Damage and Liability
PHO Services carries general liability insurance. In the event of damage caused by our personnel, clients must report the damage within 24 hours of service completion. We will investigate the claim and, if found to be our responsibility, repair or replace the damaged item up to our liability coverage limits.
We are not liable for damage to improperly secured, fragile, or irreplaceable items. Clients should remove or secure such items prior to service. Our liability is limited to the direct cost of repair or replacement and does not include consequential or incidental damages.
8. Client Responsibilities
Clients are responsible for securing all valuables, cash, jewelry, and sensitive documents prior to service. PHO Services is not liable for loss of items not properly secured. Clients should also ensure that pets are secured or removed from areas being cleaned.
Clients must disclose any known hazards on the property, including but not limited to biohazards, mold, pest infestations, or structural hazards. Failure to disclose may result in termination of service and the client may be responsible for any resulting damages.
9. Use of Products and Equipment
PHO Services uses professional-grade, eco-friendly cleaning products. If a client requests the use of specific products, the client assumes responsibility for any damage or adverse effects resulting from the use of those products.
Our personnel will use their professional judgment in selecting appropriate cleaning methods for different surfaces. Clients should inform us of any delicate surfaces or materials that require special treatment prior to service.
10. Independent Contractor Status
PHO Services operates as an independent contractor. Nothing in these Terms shall be construed to create an employer-employee relationship, partnership, joint venture, or agency between the Company and the client.
11. Non-Solicitation
Clients agree not to directly hire or solicit for employment any PHO Services personnel during the term of service and for a period of 12 months following the last service date. Violation of this provision may result in a referral fee equal to 6 months of the employee's wages.
12. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of information as described in our Privacy Policy.
13. Limitation of Liability
To the maximum extent permitted by applicable law, PHO Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to our services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or notification to the client. Continued use of our services after changes constitutes acceptance of the new Terms.
